1. Overview — Scale of India's Food Safety Problem
In a country of 1.4 billion people, food is the most intimate daily transaction. Every meal is an act of trust — trust in the vendor, the manufacturer, the supply chain, and the regulator. India's food safety crisis is the story of what happens when that trust is systematically violated at scale.[4]
The numbers from Parliament itself are unambiguous: in FY2025-26, 1 in every 5.6 food samples tested in India failed to meet required safety standards. In Uttar Pradesh — India's most populous state — over 54% of samples failed in 2024-25. In Rajasthan, 25% of food samples were found adulterated in 2024, leading to seizure and destruction of over 6.6 lakh kilograms of food. And across five years (2020-2025), more than 1.74 lakh food samples failed safety tests with penalties exceeding ₹257 crore.[1] [2] [4]
Yet these are only the tested samples. India has more than 8 crore food businesses — registered and unregistered — spanning every dhaba, chaat stall, cloud kitchen, dairy, bakery, hypermarket, and five-star restaurant in the country. FSSAI and state authorities tested 2,23,808 samples in FY2025-26. At that rate, testing every food business in India once would take over 350 years. The crisis is far deeper than any enforcement data can reveal.[1] [3]
This research brief covers the full picture: the historical context of food adulteration in India, the categories most at risk, the biggest cases that shaped national awareness, the regulatory architecture and its structural failures, the international dimension, the health burden on children, the Supreme Court's intervention, and what meaningful reform would actually require.
2. Historical Context — This Is Not a New Problem
2.1 Origins: From the Prevention of Food Adulteration Act (1954) to FSSAI (2006)
Food adulteration in India predates independence. The British colonial government passed the Sale of Food and Drugs Act in 1899. After independence, India enacted the Prevention of Food Adulteration (PFA) Act in 1954, which remained the primary food law for over 50 years — outlawing adulteration but providing limited enforcement power.[8]
By the early 2000s, India had multiple overlapping food laws administered by different ministries: the PFA Act, the Fruit Products Order, the Meat Food Products Order, the Vegetable Oil Products Order, the Edible Oils Packaging Order — at least 14 separate laws and regulatory instruments, with no unified enforcement body. Different categories of food were regulated by the Ministry of Agriculture, the Ministry of Health, the Ministry of Commerce, and others simultaneously.[8]
The Food Safety and Standards Act (FSSA) 2006 replaced this fragmented architecture with a single framework and created the Food Safety and Standards Authority of India (FSSAI) as a statutory body under the Ministry of Health and Family Welfare. FSSAI was formally established on September 5, 2008 and became fully operational in 2011.[8] [27]
2.2 How Bad Was It Before — and Has Enforcement Improved?
The historical record shows adulteration was not better before FSSAI — it was simply less documented:[3] [4] [8]
- 1990s: Concerns over adulterated milk were widespread. Common adulterants: water, salt, glucose, detergents — documented in state surveys.[29]
- 2000s: The proportion of adulterated food samples increased from 8% in 2008-09 to 20% in 2012-13 — meaning documented adulteration more than doubled in just four years.[8]
- 2011 FSSAI National Milk Survey: 70% of milk samples tested failed safety standards. The most common adulterant was water — but detergents and synthetic compounds were also found.[29]
- 2016-17: 23.4% of FSSAI-tested samples were found non-conforming.[4]
- 2018-19: 26.4% of FSSAI-tested samples were found non-conforming.[4]
- 2023-24 to 2025-26: Failure rates stabilised at approximately 18-22% per year — with more inspections happening but the failure proportion not declining.[1] [2]
The honest assessment of three decades of data: more testing is happening, more violations are being documented, and penalties are being imposed. But the proportion of food that fails safety tests has not declined meaningfully. This is the most damning fact in the entire regulatory picture.[3]
3. The Regulator — FSSAI: Architecture, Mandate, and Structural Failures
3.1 What FSSAI Is and How It Works
FSSAI is a statutory body that sets food safety standards, regulates food businesses, and coordinates enforcement through state-level food safety authorities. Its key functions:[9] [27]
- Setting standards for food products, labelling, additives, contaminants, and residues.[9]
- Licensing food businesses above a certain turnover threshold.[27]
- Coordinating state-level enforcement — carried out by Designated Officers and Food Safety Officers (FSOs).[9]
- Accrediting food testing laboratories — 22 referral laboratories, 72+ state labs, 112+ NABL-accredited private labs.[27]
- Operating Food Safety on Wheels (FSW) — mobile testing vans deployed at district level.[28]
Critical structural point: approximately 98% of food businesses in India fall under the jurisdiction of state and UT food safety authorities, not directly under FSSAI. FSSAI sets the rules; states enforce them. The weakest link in India's food safety chain is overwhelmingly at the state level.[1]
3.2 The Five Structural Failures
Failure 1: Not Enough People
There is an acute shortage of Food Safety Officers (FSOs) across India. Most states lack a separate food safety department. Parliamentary committee reports have repeatedly flagged this. In Karnataka alone, a 60% shortage in the number of FSOs was documented. With 8+ crore food businesses and only thousands of enforcement officers, meaningful routine inspection is mathematically impossible.[9] [28]
Failure 2: Not Enough Labs
India has only 87-112 NABL-accredited food testing laboratories against over 1,500 private labs — and state labs often have outdated equipment and untrained staff. The shortage of accredited labs means tested samples take long to process, enforcement action is delayed, and entire categories of contaminants (particularly emerging chemical residues) are not being systematically tested.[9] [27]
Failure 3: The Informal Sector Is Largely Invisible
The FSS Act explicitly exempts petty manufacturers, retailers, and hawkers from the full FSSAI licensing framework — precisely the category of food vendor that serves the largest proportion of India's population at the lowest price points. Street food, roadside dhabas, and local market vendors — where the most vulnerable consumers shop — are the most lightly regulated.[9] [28]
Failure 4: Standards Lag International Benchmarks
FSSAI currently covers only approximately 377 product standards — compared to 10,000+ standards maintained by regulators in more developed food economies. Maximum Residue Limits (MRLs) for pesticides in Indian food products lag behind EU standards for multiple crops and chemicals. This is why products legally sold in India can fail tests in Europe, Singapore, or Hong Kong — both are technically compliant, just with different standards.[27]
Failure 5: Enforcement Does Not Deter
From 2020 to 2025, penalties exceeding ₹257 crore were imposed across India for food safety violations. Across the same period, 1.74 lakh samples failed. These numbers do not suggest deterrence is working — they suggest the fine is treated as a cost of doing business, not a serious consequence. The FSS Act allows imprisonment of up to 6 years for selling unsafe food. Criminal prosecution is extremely rare — in FY2025-26, out of 40,023 non-conforming samples, only 1,918 criminal convictions were recorded — just 4.8% of violations resulted in criminal prosecution. The remaining 31,878 cases were resolved as civil penalty cases only.[4]
4. What Is Being Adulterated — A Category-by-Category Picture
4.1 Milk and Dairy Products — India's Most Adulterated Category
Milk is the single most adulterated food category in India by volume and by reported cases. The 2011 FSSAI national survey found 70% of milk samples failed safety standards. Repeated state surveys have shown failure rates of 40-60% in major cities:[3] [29]
- Water: The most common adulterant — increases volume at zero cost.
- Urea, detergent, caustic soda: Added to prevent spoilage and maintain fat content; both are toxic. Urea raises the nitrogen content, disguising dilution.
- Starch, glucose, salt: Added to maintain specific gravity and taste when water is added.
- Synthetic milk: Made from vegetable oil, urea, detergent, caustic soda, water — no dairy component at all. Reports from multiple states confirm synthetic milk production on small industrial scale.[5]
- Cold chain failure: Even genuine milk develops microbial contamination due to storage at 12-15°C vs the required 4°C — which is itself a form of safety failure. Boiling does not eliminate heat-stable toxins produced by bacterial growth.[21]
Paneer — India's most commercially adulterated value-added dairy product:[4] [6]
- Noida and Greater Noida (2025): 83% of paneer samples failed quality tests; 40% were deemed unsafe due to harmful chemicals and unidentified substances.[4]
- Surat, March 2026: Authorities seized 1,400 kg of suspected fake paneer allegedly made with palmolein oil, milk powder, and acid — no dairy content at all.[6]
- Common paneer adulterants: starch, synthetic milk compounds, acetic acid, calcium carbide. These are not visible to the naked eye.[5]
4.2 Spices — India's Most Internationally Embarrassing Category
India exports approximately ₹38,000 crore ($4.5 billion) of spices annually, making it the world's largest spice exporter. Food safety failures in spices are therefore not just a domestic health problem — they are a direct threat to India's export economy and international reputation.[16]
The MDH and Everest Scandal (April 2024) — the case that made the world notice:[10] [11] [12]
- On April 5, 2024, Hong Kong's Centre for Food Safety found ethylene oxide — a Group 1 carcinogen classified by the International Agency for Research on Cancer — in three MDH spice products and Everest's Fish Curry Masala.[10]
- Products banned by Hong Kong: MDH Madras Curry Powder, MDH Sambhar Masala, MDH Curry Powder, Everest Fish Curry Masala.[10]
- Singapore's Food Agency immediately ordered recall of Everest Fish Curry Masala. Maldives banned the products. The US FDA initiated an investigation.[11]
- FSSAI's response: announced it would 'conduct quality checks.' MDH and Everest both denied the allegations. The same products continued to be freely sold in India throughout the controversy.[12]
What ethylene oxide is: it is a fumigant used to sterilise spices. It is completely banned as a food fumigant in the EU since 2022. In India, its use in food is not similarly restricted. The Spices Board of India mandated ethylene oxide testing for exports to Europe in 2022 — meaning India knew there was a risk in exports but did not mandate the same standard domestically.[12]
Other documented spice adulterants across India:[5] [6]
- Lead chromate in turmeric — gives bright yellow colour; lead chromate is a toxic heavy metal compound.[6]
- Metanil yellow (a non-permitted synthetic dye) in turmeric and besan.[6]
- Coloured sawdust, rice bran in chilli powder.[6]
- Papaya seeds as black pepper adulterant.[8]
- Brick powder in chilli powder.[8]
- 12% of spice samples tested nationwide failed to meet safety standards.[4]
4.3 The Tirupati Ghee Scandal — When Adulteration Became a National Crisis (September 2024)
The most politically explosive food adulteration scandal in India's recent history did not happen in a roadside dhaba. It happened in the Tirumala Tirupati Devasthanams — the world's richest Hindu temple, visited by approximately 50,000 to 100,000 pilgrims every day, and offering approximately 3.5 lakh laddus as prasad daily.[13] [14]
What was found: A NDDB CALF (National Dairy Development Board's Centre for Analysis and Learning in Livestock and Food) laboratory test commissioned by TTD found the ghee supplied by Dindigul-based AR Dairy contained:[13] [14]
- Palm oil and tallow (95.90 to 104.10 ratio) — neither are ghee.
- Lard / animal fat (97.96 to 102.04) — pig fat.
- Fish oil (98.05 to 101.95) — fish-derived fat.
- Soya bean, sunflower, olive, rapeseed, linseed, wheat grain, maize germ, cotton seed, coconut and palm kernel fat — an extraordinary cocktail of adulterants.
Sample collection date: July 9, 2024. This means adulterated ghee was in TTD's supply chain at least from that point. FSSAI issued a show-cause notice to AR Dairy. TTD filed a police complaint. AR Dairy denied the allegations. A purification ritual was conducted at the temple. The case became a major political controversy between the TDP and YSRCP governments.[13] [14]
The significance: if adulteration can penetrate the supply chain of the Tirumala Tirupati Devasthanams — India's most-scrutinised religious institution, with its own procurement system and lab testing — the implied risk for ordinary consumers purchasing ghee without any institutional quality control is even greater.[13]
4.4 Fruits and Vegetables — Artificial Ripening and Colour Enhancement
Several documented practices affect fresh produce safety:[5] [6]
- Calcium carbide: Used to artificially ripen mangoes, bananas, and other fruits. Its hydrolysis produces acetylene gas, which mimics the ripening effect of natural ethylene. Calcium carbide contains trace amounts of arsenic and phosphorus hydride, both toxic. Its use on food is banned under FSSAI regulations — enforcement is minimal.[5]
- Malachite green: A synthetic dye used to artificially green vegetables like cucumbers and leafy vegetables — giving them an appearance of freshness. Malachite green is a known carcinogen.[6]
- Oxytocin injection on cucumbers and gourds: Some farmers inject oxytocin (a hormone) to accelerate vegetable growth; technically banned for this use.[5]
- Banned pesticide residues: FSSAI routinely finds pesticide residues on vegetables and fruits above permissible levels. In 2024-25, specific monitoring on vegetables found widespread violations in UP, Rajasthan, and Maharashtra.[2]
- Sour, overripe or rotten fruits processed into juice: Documented in multiple viral videos; juice manufacturers sometimes use overripe fruit not saleable in markets. These products are sold as 'fresh juice.'[6]
4.5 Railway Food — India's Most Captive Consumer Situation
Railway passengers are among the most economically captive food consumers in the country. Once a train departs, passengers cannot choose alternative vendors. IRCTC manages catering for approximately 13,000 trains per day carrying roughly 23 million passengers.[7]
Documented incidents verified across multiple sources:[7]
- Trustified Labs test, April 2026: Blind lab test on Vande Bharat Thali showed dal containing Enterobacteriaceae bacteria at 50x the FSSAI limit, jeera rice at 70x, paneer subzi with E. coli at 11x and Bacillus cereus at 2.2x. IRCTC disputed the results; the test was not conducted by a government-authorised surveillance body.[7]
- Worms in Vande Bharat curd: Passenger video; FSSAI issued ₹60 lakh fine to the contractor.[7]
- October 2025: Pantry staff caught washing and reusing single-use disposable containers on Vande Bharat. Viral video.[7]
- 2018: Vendor caught making chai using water from a public toilet facility at a railway station. Case documented and widely reported.[7]
- Reuse of used food foils; plates retrieved from garbage bins — multiple documented cases, multiple years.[7]
The systemic issue: IRCTC outsources catering to private contractors across thousands of stations. Supervision of these contractors across the full rail network is structurally impossible with current resources. Price competition in contractor tenders creates economic pressure to cut costs — food quality is among the first casualties.[7]
4.6 Packaged and Processed Foods — The Invisible Ingredients
Packaged food presents a different category of risk: not adulteration in the traditional sense, but legal additives that are permitted in India but banned or restricted in other countries, combined with misleading labelling that creates false impressions about product content.[19] [20]
Titanium Dioxide (E171 / Color 171):[19] [20]
- Used as white colouring agent in Gems candy, white-coated confectionery, sugar coatings.[20]
- In May 2021, the European Food Safety Authority (EFSA) published a safety reassessment concluding: 'Titanium dioxide can no longer be considered safe as a food additive.' The specific concern: nanoparticles can break DNA strands and cause chromosomal damage (genotoxicity).[19]
- EU ban on E171 in all food products came into effect August 7, 2022. As of 2026, over 36 countries have banned E171 in food.[19]
- In India: FSSAI has not banned titanium dioxide in food. No warning label is required.[20]
Tartrazine (E102 / Color 102):[20]
- Petroleum-derived synthetic yellow azo dye used in candies, soft drinks, confectionery.[20]
- EU food labels must carry the warning: 'May have an adverse effect on activity and attention in children' when tartrazine is present. UK Food Standards Agency recommends parents of children with hyperactivity consider eliminating it.[20]
- India: no such warning requirement. Widely sold in children's products without any labelling indication.[20]
Misleading health claims in labelling — documented patterns:[5]
- Products named 'atta bread' or 'brown bread' that contain minimal whole wheat and primarily maida, sugar, and synthetic colours.[5]
- Products using 'fresh' as a brand trademark with a disclaimer on the reverse stating 'it does not represent its true nature.'[5]
- 'Health drinks' marketed for children that contain 47-55% sugar by weight — creating significant sugar intake in children who are already consuming it from other sources.[5]
5. Major Cases That Defined National Awareness
Five cases across the last decade collectively reshaped public and regulatory consciousness about food safety in India. Together they show how adulteration affects every level of the food chain — from mass market to premium, from export brands to temple prasad.[4] [11] [13]

6. School Food Poisoning — When the Victims Are Children
India's Pradhan Mantri Poshan Shakti Nirman (PM Poshan) — formerly the Mid-Day Meal Scheme — serves cooked meals to approximately 120 million children in over 1 million schools across the country. It is the largest school meal programme in the world. It is also a recurring food safety disaster.[25]
Verified documented incidents across recent years:[25] [26]
- July 27, 2024 — Wayanad, Kerala: Over 130 students hospitalised after suspected food poisoning from school midday meal. More than 1,000 children had consumed the meal on that day.[26]
- October 2024 — Thane, Maharashtra: 45 children hospitalised from a school; a private school's midday meal was found to be the cause. Seven more fell ill in subsequent days.[26]
- January 2026 — Sangareddy, Telangana: 22 children fell ill out of 42 who ate midday meal at a school in Venkatapur. Staff had allegedly reheated leftover food from a local function and served it as the midday meal.[25]
- April 2025 — Mokama, Bihar: Over 100 children fell ill after the school midday meal was found to contain a dead snake. India's human rights commission launched an inquiry.[25]
- 2022 — India-wide IDSP data: 979 victims of food poisoning in schools recorded in that single year by the Integrated Disease Surveillance Programme and media reports.[25]
The pattern across all mid-day meal poisonings is consistent: insufficient cold storage, reheating of leftover food, unhygienic kitchen conditions, and inadequately trained food handlers. The scheme serves the most nutritionally vulnerable children in India — and at the most important developmental window (ages 6-14). A food poisoning incident is not just a health event; it undermines school attendance and parental trust in the programme.[25]
7. The Health Burden — What Food Unsafe Food Is Doing to India
7.1 WHO Global Estimates — June 2026 Update
On June 4, 2026, the World Health Organization released its updated global burden of foodborne disease estimates — the first full update since 2015:[15]
- 866 million illnesses and 1.5 million deaths annually worldwide from unsafe food.[15]
- South-East Asia (including India) has the second-highest burden after Africa, with more than 150 million foodborne illness cases and 175,000 deaths annually in the region.[23]
- Chemical hazards (industrial contaminants, pesticide residues, mycotoxins) account for 73% of deaths from contaminated food — meaning the invisible chemical adulterants kill more than the bacterial ones.[15]
- Children under 5 face almost 3 times the risk of illness from unsafe food compared to older groups — they represent just 9% of the global population but suffer nearly one-third of all foodborne disease cases.[15]
7.2 India's Child Nutrition Crisis — The Hidden Connection
The connection between food safety and child malnutrition is direct but rarely discussed in food safety debates. When food is adulterated, stripped of nutrients, or replaced with non-nutritive substitutes, children who consume it get calories without nutrition:[22] [29] [30]
- UN SOFI Report 2025: 18.7% of Indian children under 5 suffer from wasting (low weight for height) — the highest rate in the world. More than 21 million Indian children had low weight for height due to inadequate quantity or quality of food.[22]
- NFHS-5 (2019-21): 35.5% of children under 5 are stunted; 19.3% are wasted; 32.1% are underweight.[29]
- NFHS-6 (2026): 29% stunted, 19% wasted. Despite economic growth, progress is slow and uneven. Wasting actually increased in states like Gujarat (from 19% to 24%).[30]
- India has the largest number of stunted children in absolute terms globally — contributing 24.6% of the world's total.[22]
- Over half of Indian women aged 15-49 are anaemic (53.7% in 2023, 203 million total) — contributing to poor maternal nutrition which directly affects infant health.[22]
The connection: adulterated milk and dairy fed to young children means the protein, calcium, and fat they are supposed to receive is being replaced by water, starch, or synthetic substitutes. Adulterated complementary foods provide empty calories. This is not the only cause of malnutrition — poverty, sanitation, and healthcare access all contribute — but it is a direct and underappreciated contributor.[29]
7.3 The Economic Cost
The World Bank estimates India's annual economic burden from foodborne diseases at approximately US $15 billion (~₹1.25 lakh crore) per year. This includes:[16]
- Direct hospitalisation and medical costs.[16]
- Lost workdays and productivity.[16]
- Household income diverted from savings and investment to treatment.[16]
- Government healthcare spending on avoidable illness.[16]
For context: India's entire Union Health Ministry budget for FY2025-26 is approximately ₹90,000 crore. The World Bank's estimated annual cost of foodborne illness — ₹1.25 lakh crore — is 38% higher than India's total health ministry budget. The country spends money treating illness caused by food it could prevent.[16]
The export dimension: India's agricultural exports were worth $51.91 billion in FY2024-25, reaching 200+ countries. When Indian food products fail international safety standards — as MDH and Everest did in 2024, and as Indian spices repeatedly do in EU rapid alerts — entire export categories face restriction. Domestic food safety failure directly costs India its competitiveness in global food trade.[16]
8. The International Double Standard — What India Allows That Others Don't
One of the most systemic failures in India's food safety framework is the gap between the standards India applies to its export food and the standards it applies to food consumed domestically. The same product can be legally sold in India and banned in Europe — not through hypocrisy alone, but because India's regulatory standards are structurally lower across multiple categories.[12] [16] [19]
