PART 1 — The Hook: You Ate Today. What Are the Odds It Was Safe?

The government tested 2,23,808 food samples in FY2025-26. One in every 5.6 failed. That's 40,023 samples of food that failed safety standards — in a single year. You ate today. What are the odds?
Start there. Not with a history lesson. Not with a government report. Start with the question that lands in every viewer's stomach the moment they hear the number.[1]
In FY2025-26, the Food Safety and Standards Authority of India and state food safety authorities analysed 2,23,808 food samples across the country. 40,023 were found non-conforming — failing to meet required safety standards. That figure was disclosed by the Ministry of Health and Family Welfare in a written reply to the Lok Sabha on July 24, 2026.[1]
The ministry also confirmed: 1,918 criminal convictions. 31,878 civil penalty cases. 4,461 food business licences suspended. 11,493 licences cancelled over the last five years.[1] [3]
The math no one says out loud: India has over 8 crore food businesses — restaurants, dhabas, cloud kitchens, street vendors, factories, dairies, bakeries. FSSAI tested 2,23,808 of them. At that rate, testing every food business once would take over 350 years.[16]
The 2,23,808 samples tested are not a safety net. They are a performance. India's food supply is essentially untested.
PART 2 — What Is Actually In the Food

Here is the most important thing to understand about Indian food adulteration in 2025: it has changed. What it was ten years ago — visible, physical, crude — is not what it is today. The poison has become invisible.[6] [22]
2.1 The Old Adulteration — What You Could See
In the 1990s and early 2000s, adulteration was physical and obvious if you knew what to look for. Water mixed into milk. Chalk powder mixed into wheat flour. Papaya seeds passed off as black pepper. Brick powder in chilli. These required no chemistry — just greed and scale.[5] [13]
The 1998 Delhi epidemic dropsy outbreak was the defining catastrophe of this era: argemone oil — from the poisonous Mexican poppy — was mixed into mustard oil across Delhi. More than 3,000 people were hospitalised. Over 60 died. Autopsies confirmed the cause. Suppliers went to jail. And the practice continued in other forms in other states in subsequent years.[5]
2.2 The New Adulteration — What You Cannot See
2025 marked a documented shift in the nature of Indian food adulteration. Multiple reports and surveillance data confirmed what food scientists had warned for years: adulterants had become chemical, sophisticated, and laboratory-invisible to standard testing tools.[6] [22]
- Milk: Nitrogen-rich compounds added to fake higher protein content. Synthetic milk manufactured from vegetable oil, urea, detergent, and caustic soda — zero dairy content. Neutralisers added to mask acidity in stale milk. Maharashtra's Bhum taluka: police discovered a racket that used 2.3 lakh kilograms of cheap milk powder, industrial detergent, and palm oil to manufacture 23.04 lakh litres of fake milk between January and June 2026.[6] [29]
- Spices: Industrial dyes (metanil yellow, Sudan red) mixed into turmeric and chilli. Lead chromate added to turmeric for brightness — a known neurotoxin. Ethylene oxide fumigant residues — a Group 1 carcinogen — found across spice supply chains. 12% of nationally tested spice samples failed quality standards.[28]
- Eggs and poultry: December 2025: nitrofuran residues detected in eggs across multiple states. Nitrofurans are banned veterinary antibiotics illegally used in poultry to control infections and boost growth. They are associated with DNA damage and carcinogenicity. Their detection requires advanced laboratory analysis that most state food labs cannot conduct.[6]
- Paneer: 83% of paneer samples in Noida and Greater Noida failed quality tests in 2024. 40% were deemed unsafe due to harmful chemicals. In March 2026, Surat authorities seized 1,400 kg of fake paneer made with palmolein oil, milk powder, and acid — no dairy whatsoever.[28]
- Honey: Sugar syrups, rice syrups, and corn syrups used to dilute or entirely replace honey. Requires NMR (nuclear magnetic resonance) testing to detect — not available in most FSSAI state labs.[6]
The nature of adulteration is evolving faster than the testing infrastructure. Modern adulterants are 'lab-aware' — engineered to pass the standard tests FSSAI labs can conduct. India's testing labs are fighting yesterday's enemy.
The most chilling case in recent memory: Tirupati Laddoo Prasad. In September 2024, NDDB's CALF laboratory confirmed that ghee supplied by Dindigul-based AR Dairy to the Tirumala Tirupati Devasthanams — India's most-visited temple, distributing 3.5 lakh laddus daily — contained palm oil, lard (pig fat), fish oil, tallow, soya bean, sunflower, rapeseed, linseed, maize germ, cottonseed, coconut, and palm kernel fat. None of it was cow ghee. This was not found in a street stall. This was prasad.[8]
PART 3 — Two Standards: What India Exports vs What Indians Eat

The European Union flagged over 527 Indian food products for contamination between 2020 and 2024. Every single one of them was an export-quality product. The same food sold domestically faced no equivalent scrutiny.
This is the most politically explosive section of the India food safety story — and the least covered in mainstream Indian media. The evidence shows clearly that India applies a different standard to food it sends abroad and food it gives its own citizens.[9] [10] [11]
3.1 The Export Evidence — What the EU's RASFF Database Shows
The EU's Rapid Alert System for Food and Feed (RASFF) — an online system that traces the safety of food entering European Union member countries — documented the following about Indian food products:[9] [10]
- 527 Indian food products flagged between September 2020 and April 2024 — most of them nuts and sesame seeds (313), herbs and spices (60), and dietetic foods (48). 87 consignments were rejected at the EU border outright.[9]
- 365 additional Indian products flagged between May 2024 and June 2026 — Deccan Herald's investigation citing RASFF data (June 6, 2026). Chlorpyrifos, ethylene oxide, lead, and mercury featured across the alerts.[10]
- The primary contaminant found: ethylene oxide — a Group 1 carcinogen classified by the International Agency for Research on Cancer (IARC) as definitively cancer-causing in humans. The EU's permissible limit for ethylene oxide in food is 0.1 mg/kg. India did not have equivalent domestic restrictions in place when these alerts were issued.[11] [12]
- 14 products contained lead. Mercury and cadmium were found in fish products — octopus, squid, cuttlefish. At least 59 products contained pesticides classified as carcinogenic. Over 52 products had residues of five or more different pesticides simultaneously.[9]
- PAN Europe's September 2024 report named India as the #1 exporter of banned-pesticide products into EU markets — 24% of flagged samples came from India, ahead of Uganda (18%), China (17%), Kenya (17%), and Brazil (16%).[10]
3.2 The Spices Board Admission — The Double Standard Made Official
In 2022 — years before the MDH and Everest scandal became global news — India's Spices Board issued an advisory urging exporters to test their products for ethylene oxide before shipping to Europe.[11]
This is the official confirmation of the double standard. The Spices Board knew ethylene oxide was a problem in Indian spices. It mandated testing for food going abroad. It did not mandate equivalent domestic testing. The Indian consumer was given no similar warning, no protection, and no choice.[11]
When Hong Kong banned MDH and Everest products in April 2024, FSSAI announced it would 'conduct quality checks' on these products. The products remained on Indian shelves throughout. FSSAI has no authority over exported spices — the Spices Board of India handles exports. So the domestic regulator watched a crisis unfold internationally and had no jurisdiction to act on the exports that were causing it.[12]
India mandated cancer-risk testing for food going to Europe. Not for food going to its own citizens. That is the double standard, stated in official policy.
3.3 The Packaged Food Double Standard — What India Allows That 36+ Countries Don't
- Titanium Dioxide (E171 / Color 171): Used as white colouring in Gems candy, coated confectionery, white-coated pills disguised as candy. The EU banned it from all food on August 7, 2022, after the European Food Safety Authority found it could not be considered safe — specifically citing genotoxicity (DNA strand breakage). 36+ countries have banned it. India has not. No warning label is required on Indian products.[6]
- Tartrazine (E102 / Color 102): Petroleum-derived synthetic yellow dye in Indian candies, drinks, snacks. EU food labels must carry the mandatory warning: 'May have an adverse effect on activity and attention in children.' India requires no such warning. The same candy — different label, different protection for the child eating it.[6]
- Front-of-pack warning labels: Chile, Mexico, Brazil, Israel, Canada all mandate labels on packaged food that clearly say 'HIGH IN SUGAR,' 'HIGH IN FAT,' 'HIGH IN SALT.' India has been debating this for 4+ years. The food industry lobbied against it. The Supreme Court had to intervene twice in 2026 to force FSSAI to comply with its own direction. The label India cannot implement in 4 years, Chile implemented in 2016.[17] [18]
PART 4 — The Regulator: Who Is Responsible and Where the Chain Breaks

The accountability question is not simple. India has a food safety law. It has a national regulator. It has state-level enforcement. It has courts. It has a Supreme Court that is actively monitoring. So who is responsible for 40,023 samples failing in FY2026?[1] [16]
4.1 The Chain of Command — Who Runs Food Safety in India
The structure, from top to bottom:[16]
- Ministry of Health and Family Welfare — the parent ministry. Currently also holds the FSSAI Chairperson position via additional charge.
- FSSAI Chairperson: Ms. Punya Salila Srivastava (IAS, 1993-AGMUT batch), who also serves as Secretary, Department of Health and Family Welfare. She holds the chairperson role on additional charge — not as a full-time dedicated position. Extension approved by the Appointments Committee of the Cabinet (ACC) for six months from August 1, 2025.
- FSSAI CEO: Rajit Punhani (IAS, 1991 batch, Bihar cadre). Took charge September 1, 2025. St. Stephen's College economics graduate, IIM Bangalore MBA. His appointment came at the precise moment the Supreme Court was pressing FSSAI hardest on warning labels.
- State Commissioners of Food Safety — each state has one. They coordinate actual enforcement. 98% of food businesses fall under state jurisdiction, not FSSAI directly.
- Designated Officers and Food Safety Officers (FSOs) — the actual inspectors on the ground. Chronically understaffed. Karnataka alone documented a 60% shortage of required FSOs.
- Accredited food testing laboratories — where samples go after collection. Only 112 NABL-accredited labs nationally. Most state government labs have outdated equipment. Many lack the instruments to detect the new class of chemical adulterants.
The FSSAI Chairperson holds the role on 'additional charge' alongside running India's entire health ministry. This is not a small structural detail — it signals the institutional priority India places on food safety.
4.2 The Law — What Can Happen to Those Who Are Caught
The law exists. The punishments on paper are serious:[13] [15]
- Sale of substandard food: Minimum 6 months imprisonment, extendable to 3 years. Minimum ₹1,000 fine.
- Food adulterated with injurious substances: Minimum 1 year, extendable to 6 years. Minimum ₹2,000 fine.
- Food causing grievous bodily harm or death: Minimum 3 years, extendable to life imprisonment. Minimum ₹5,000 fine.
- IPC Sections 272–273 (the original food adulteration provisions): Maximum 6 months and a fine of ₹1,000. A Parliamentary Standing Committee noted in 2023 that 'most cases under the Prevention of Food Adulteration Act are acquitted because of procedural lapses in sample collection.' The committee recommended minimum 6 months imprisonment with a minimum ₹25,000 fine.[14]
The reality: In FY2026, 40,023 samples failed. Criminal convictions: 1,918. That's 4.8%. The other 95.2% of violations were resolved through civil penalties — fines so small that a profitable adulterator treats them as a cost of doing business. The Education Post monograph puts it plainly: 'The failure of fear. If the expected cost of adulteration remains manageable, then even a strong law at the outer edge may not deter routine wrongdoing.'[1] [3] [5]
Over 5 years, India analysed over 5.18 lakh food samples. Result: 88,192 penalty cases and 3,614 criminal convictions. That is one criminal conviction for every 143 samples that failed.

4.3 The Industry Capture — Why the Supreme Court Had to Intervene
The front-of-pack warning label story is the clearest evidence of regulatory capture in India's food safety system.[17] [18]
- April 2025: Supreme Court directs FSSAI to finalise front-of-pack nutritional labelling recommendations within 3 months.
- January 2026: FSSAI files an affidavit saying it will 'conduct further research and undertake systematic mapping.' Translation: more delay.
- February 10, 2026: Supreme Court bench led by Justice JB Pardiwala issues a direct direction — not a suggestion — to implement 'HIGH SUGAR,' 'HIGH FAT,' 'HIGH SALT' warning labels on HFSS (high fat, sugar, salt) packaged foods.
- March 2026: FSSAI holds a stakeholder consultation. The majority of industry organisations oppose warning labels. They propose instead a system that 'provides information without alarming consumers.'
- August 2026: FSSAI files a new affidavit — this time, shifting away from interpretive labels toward a plain nutrition table. Supreme Court bench: 'Does the Government not want its people to be healthy?' Court accuses FSSAI of 'succumbing to industry pressure.' Gives FSSAI a 'final opportunity.'[18]
The bench observed: 'They [food manufacturers] may not like this as it affects their business. But why are you reluctant to do this?' The government's counsel argued that warning labels would make 'namkeen and even eggs' look unhealthy — and that one-third of India's MSMEs produce traditional foods.[18]
A simple 'HIGH SUGAR' label on a packet of candy — something Chile implemented in 2016, Mexico in 2020, Canada in 2023 — required five rounds of Supreme Court intervention in India. That gap is not accidental. It is the result of a food industry that successfully lobbied a regulator into inaction for four years.
PART 5 — The Human Cost: Who Is Actually Dying

WHO, June 4, 2026: Unsafe food causes 866 million illnesses and 1.5 million deaths every year. Children under 5 suffer nearly one-third of all cases despite being just 9% of the population. India sits in the second-highest burden region on Earth.
These numbers come from the World Health Organization's updated global burden of foodborne disease estimates — the first full update since 2015, released June 4, 2026, published in The Lancet Global Health.[4]
5.1 The Global Picture — India's Position
- 866 million illnesses annually from unsafe food. 1.5 million deaths.[4]
- Chemical hazards (pesticide residues, heavy metals, industrial contaminants) account for 73% of deaths from contaminated food — killing more than bacteria and viruses combined. Inorganic arsenic and lead are linked to more than 1 million deaths annually.[4]
- South-East Asia — the region India sits in — has the second-highest burden globally after Africa: more than 150 million illness cases and 175,000 deaths annually from foodborne disease.[30]
- Children under 5 carry 3 times the risk of illness from unsafe food compared to older children and adults. They are just 9% of the global population but suffer nearly one-third of all foodborne disease cases.[4]
5.2 The Connection Nobody Makes — Adulterated Food and India's Malnutrition Crisis
India has the world's highest child wasting rate — 18.7% of children under 5 have low weight for height, per the UN SOFI 2025 report. More than 21 million Indian children had low weight for height due to inadequate quantity or quality of food.[19]
NFHS-6 (2026): 29% of children under 5 stunted. 19% wasted. The wasting rate in Gujarat — one of India's wealthier states — actually increased from 19% to 24% between NFHS-5 and NFHS-6. In Gujarat, barely 8% of children aged 6-23 months receive an adequate diet.[20]
The connection that food safety conversations almost never make: when the milk fed to a child contains water, starch, and urea instead of protein and fat, and the paneer contains palmolein oil instead of dairy, and the wheat flour contains chalk powder instead of grain — the child consuming it receives calories without nutrition. Every meal becomes a wasted opportunity for nourishment. India's malnutrition crisis and its food safety crisis share the same supply chain.[21]
Over half of Indian women aged 15-49 are anaemic — 203 million total. India has the largest number of stunted children in absolute terms globally. And 40,023 food samples fail safety standards every year. These are not separate problems.
5.3 The Children Who Ate School Lunch
The PM Poshan scheme feeds approximately 120 million children in over 1 million schools — the largest school meal programme in the world. Recent documented incidents:[4]
- July 2024 — Wayanad, Kerala: 130+ students hospitalised from a school midday meal. More than 1,000 children consumed the same meal.
- October 2024 — Thane, Maharashtra: 45 children hospitalised. Cause: school midday meal.
- January 2026 — Sangareddy, Telangana: 22 children fell ill. Staff had allegedly reheated leftover food from a local function and served it as the midday meal.
- April 2025 — Mokama, Bihar: Over 100 children fell ill after a dead snake was found in the school midday meal.
- 2022 — India-wide IDSP data: 979 victims of food poisoning in schools recorded in a single year.
These are not anomalies. They are a recurring pattern in a programme feeding the most nutritionally vulnerable children in India, operated through a procurement chain that is under-supervised, under-funded, and under-tested.[4]
PART 6 — The Uncomfortable Truth: Is It Getting Better or Worse?

The headline numbers suggest improvement. The reality is more complicated.[1] [6] [22]
6.1 The Numbers That Look Like Progress
- 2016-17: 23.4% of FSSAI-tested samples failed.
- 2018-19: 26.4% failed.
- 2022-23: 25.7% failed.
- FY2025-26: 17.9% failed (1 in 5.6).[1] [28]
That is a genuine reduction. Inspections also increased significantly: from 3,57,072 in 2023-24 to 5,20,566 in 2025-26 — a 46% increase in inspections in two years.[1]
6.2 Why the Improvement Is Deceiving
The lower failure rate could mean one of three things:[6] [22] [27]
- Option A — Food is actually safer: Enforcement is working, adulterators are deterred, quality is genuinely improving.
- Option B — Testing is catching less: Standard lab tests detect simple, known adulterants. Modern chemical adulterants (nitrofurans in eggs, nitrogen compounds in milk, synthetic mimics in honey) cannot be detected by basic tests. A sample can pass a standard FSSAI test and still contain chemical residues that cause cancer. A lower failure rate may partly reflect tests that no longer catch what they once caught.
- Option C — The denominator is changing: More inspections in lower-risk sectors (large registered food businesses) could pull the overall failure rate down even if high-risk informal sectors remain as dangerous as ever.
The Equinox Lab's 2026 Ingredient Quality Guide — a food industry publication — put it directly: 'Modern adulterants are often chemical mimics... These require specialised NABL-accredited laboratory analysis to detect. A one-and-done annual audit is no longer sufficient. Laboratory adulterants are becoming more lab-aware.'[22]
The nature of adulteration has shifted from visible to invisible, from physical to chemical, from simple to laboratory-designed. The food safety enforcement system was built to catch the old adulteration. The new adulteration knows how to avoid being caught.[6] [22]
In December 2025, nitrofuran residues — banned veterinary antibiotics linked to DNA damage — were detected in eggs across multiple Indian states. Nitrofurans require specialised NMR testing. Most state FSSAI labs do not have this equipment. The eggs that didn't get detected passed 'safe.' They are in the market. They are on your plate.
PART 7 — What Would Actually Fix This: Accountability and a Way Forward

Every year for the past decade, India has had this conversation. The numbers are published. The Parliament is informed. The Supreme Court intervenes. A few people are fined. And the next year, 40,000 more food samples fail.[1] [5]
So let's talk about what countries that actually solved this did. And then let's talk about what India would need to do.[23] [24] [25]
7.1 What Chile Did — And What Happened
In 2016, Chile became the first country in the world to mandate front-of-pack black octagon warning labels on packaged food products high in sugar, salt, saturated fat, or calories. The labels are simple, non-negotiable, and impossible to miss. Not 'nutritional information.' Not a star rating. A black octagon that says: HIGH IN SUGAR.[24] [25]
What happened after Chile implemented these labels, verified by peer-reviewed studies published in PLOS Medicine:[24]
- Purchases of labelled 'high in' foods decreased by 23.8% in calories, 36.7% in sodium, and 26.7% in sugars compared to the counterfactual.[24]
- Products reformulated: the proportion of products with any 'high in' label declined from 51% to 44% — because manufacturers changed their recipes to avoid the label.[24]
- Mexico (2020) followed Chile's model. Canada (2023) implemented similar mandatory labels. Brazil, Israel, Argentina, Colombia, Peru, and Uruguay all adopted variants. In Mexico, warning labels have been credited with improving consumer understanding and shifting purchasing behaviour across income groups.[25] [26]
India has been debating whether to do this for 4 years. The industry argued that warning labels would make even eggs look dangerous. The Supreme Court called this out directly: 'How many people can afford dry fruits? And how many children buy Kurkure? That makes all the difference.'[18]
7.2 What China Did After 2008
In 2008, melamine — an industrial chemical used in plastics — was deliberately added to infant formula in China to boost apparent protein levels. Six babies died. 300,000 were sickened. 54,000 were hospitalised.[5]
China's response was not a committee report or an advisory. Two people were executed. Others received life sentences. The government launched a comprehensive overhaul of its food safety system — new laws, new institutions, new testing infrastructure, and criminal liability for company executives, not just line workers. The message was: food adulteration is not a commercial offence. It is a crime against the state.[5]
India's maximum punishment for food adulteration causing death is life imprisonment and a ₹10 lakh fine. In five years, India recorded 3,614 criminal convictions across 5.18 lakh failed samples. The punishment exists on paper. The deterrence does not exist in practice.[5] [27]
7.3 What India Specifically Needs — The Honest List
This is not a wishlist. These are the verified, documented gaps between India's food safety system and the minimum required to protect 1.4 billion people:[1] [16] [17]
- 1. Implement front-of-pack warning labels — now, not after a 5th Supreme Court hearing. Chile did it in 2016. Canada did it in 2023. The evidence shows they work. The only reason India hasn't done it is industry lobbying.[23]
- 2. Expand food safety officer capacity by 5x. Most states have 40-60% shortages. Inspections cannot happen without inspectors. This is a hiring problem and a political will problem.[16]
- 3. Upgrade state lab infrastructure to detect chemical adulterants. NMR testing for honey. Mass spectrometry for antibiotic residues in eggs. Advanced pesticide residue analysis. Without the equipment, the test fails the consumer before it begins.[22]
- 4. Apply the same domestic food standards to Indian consumers that India applies to export markets. The Spices Board mandated ethylene oxide testing for exports in 2022. This should be mandatory domestically. Immediately.[11]
- 5. Make criminal prosecution the default, not the exception. 4.8% of violations result in criminal conviction. That is not deterrence — it is invitation. Without real criminal consequences, adulteration is rational economics.[1] [3]
- 6. Create a public, real-time database of failed samples, enforcement actions, and company names. Every violation should be publicly named within 30 days. Transparency is the cheapest and most powerful consumer protection tool available.[16]
The consumer is the last line of defence in a system that has failed them at every other point. The label reader, the question asker, the complaint filer — these are not burdens on the consumer. They are the only functional feedback loop left in India's food safety chain.
The final question is not technical. It is moral. A country that built an IT sector from scratch, runs a space programme, and manages the world's largest democracy — that country can put a lab in every district headquarters. That country can train 50,000 food safety officers. That country can put a black octagon on a packet of chips.[18]
The question is not whether India can. The question is whether it has decided that 1.4 billion people eating safe food is worth the political cost of confronting the industry that profits from the alternative.
